The Federal Government has revised its Fair and Lawful Building Sites Code, which could be the key to withholding infrastructure money from the new Victorian Government.

Victoria elected a new premier over the weekend, with Labor’s Daniel Andrews saying he will tear up contracts signed for the multi-billion-dollar East West Link project.

Premier-elect Daniel Andrews has spoken to Prime Minister Tony Abbott on his first day in the new job, assuring the PM that he still intends to scrap deals made so far.

But the talk comes just days after Minister for Employment Eric Abetz put out the new Code, which he says may be used to pull federal money out of the state.

Senator Abetz says the new Code ensures that taxpayer-funded construction projects are built productively, on time, without waste and on budget, in a safe manner and only by companies that comply with the law.

“Compliance with the Code will be a condition of any new Commonwealth funding to the States for major infrastructure projects,” he said.

“States which do not agree to apply the Code to such projects will not receive funding.

“Victorian voters should be in no doubt... Labor’s policy to oppose the Code means that Daniel Andrews will deny their State $7.6 billion in new infrastructure funding.”

The revised Code makes it clear to unions that the requirements of the Building Code do apply to variations of enterprise agreements.

Other adjustments to the Code clarify that contractors must comply with immigration laws and visa requirements or lose the ability to do Commonwealth Government-funded work.

The Fair and Lawful Building Sites Code will come into effect and apply to all Commonwealth Government-funded construction if legislation to re-establish the Australian Building and Construction Commission is passed.
